Terms of Use

These Terms of Use (the Terms) govern your use of Roger & Mary: the website at www.rogerandmary.com, its French edition Hubert & Odette at www.hubertetodette.fr, and the Roger & Mary mobile app for Android and iOS (together, the Service). Please read them carefully.

By creating an account, accepting an invitation or using the Service, you agree to these Terms, to our User Agreement and to our Privacy Policy. If you do not agree, please do not use the Service.

1. The Service

Roger & Mary lets families share photos privately. Members create circles, invite relatives to join them, and share photos in them. They can then date, locate, tag and comment on those photos together. The Service is currently provided free of charge.

2. Who can use the Service

  • You must be at least 16 years old to create an account.
  • You must give accurate information when you register and keep it up to date.
  • You may only have one personal account, and you may not create an account on behalf of someone else without their permission.

3. Your account

  • You are responsible for keeping your password and sign-in links confidential, and for everything that happens under your account.
  • Tell us straight away at thomasjestin@gmail.com if you think someone else has accessed your account.
  • Sign-in links sent by email are personal. Do not forward them.

4. Your content

You keep ownership

You keep all rights to the photos, comments and other content you post (your Content). We do not claim ownership of it.

The licence you give us

To run the Service, you give us a non-exclusive, royalty-free, worldwide licence to host, store, copy, resize and display your Content. This licence is limited to what is needed to show your Content to the members of the circles you share it with. It ends when you delete the Content or your account, except for copies in backups, which are removed as they are overwritten. We will never use your photos for advertising, or share them publicly, without your permission.

Your responsibilities

You confirm that you own your Content or have the right to share it. You also confirm that sharing it does not infringe anyone else's rights, including copyright and the right to privacy and to one's own image. In particular, you should only post photos of other people, and especially of children, when you are entitled to do so.

5. Acceptable use

You agree not to:

  • post content that is illegal, sexually explicit, hateful, harassing, violent or defamatory, or that exploits or endangers children in any way;
  • post content you do not have the right to share, or share other members' photos outside the Service without their permission;
  • invite or add people who have not agreed to be contacted, or use the Service to send spam;
  • impersonate another person, or misrepresent your relationship with someone;
  • try to access accounts, circles or data you are not authorised to see, or collect other users' data by automated means;
  • interfere with the Service or its security, for example by introducing malware, overloading our systems, or reverse engineering the app beyond what the law allows;
  • use the Service for any commercial purpose without our written permission.

6. Circles and other members

Circle creators and members have different permissions: for example, to invite people, remove members or hide photos. These are described in the Service. You are responsible for choosing whom you invite and which circles you share each photo with. We are not responsible for how other members use content that you have chosen to share with them.

7. Removal of content and suspension

We may remove content or restrict, suspend or close an account if we reasonably believe it breaches these Terms or the law, or puts other users or the Service at risk. Where appropriate, we will tell you why. If you think we made a mistake, contact us.

8. Ending your use of the Service

You can stop using the Service at any time. You can request deletion of your account and data at https://staging.rogerandmary.com/delete-account. We review and action requests within 7 working days. Photos and comments that other members posted will remain in their circles, but tags identifying you will be removed.

9. Changes to the Service

We are continually improving the Service and may add, change or remove features. We may also suspend or stop the Service, in whole or in part. If we decide to close the Service permanently, we will give you reasonable notice so that you can save your photos.

10. Disclaimer

We work hard to keep the Service available and your photos safe. However, the Service is provided "as is" and "as available", and we cannot guarantee that it will always be uninterrupted or error-free. Please keep your own copies of photos that matter to you. Nothing in these Terms affects the statutory rights you have as a consumer.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss. This includes loss of data, profits or opportunity, and loss caused by other members' content or behaviour. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for gross negligence, fraud or death or personal injury caused by negligence.

12. Changes to these Terms

We may update these Terms. We will change the "Last updated" date above and, for significant changes, notify you by email or in the Service before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms.

13. Governing law

These Terms are governed by French law. Before starting any legal action, please contact us so we can try to resolve the issue amicably. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts there.
